Welcome to Early Foundations Academy. Early Foundations Academy is owned and operated by MSGM Group Pty Ltd (ABN 26 698 857 493). These Terms & Conditions (“Terms”) govern your use of our website and the provision of early education and care services at our centre at 53 Clyde Avenue, Moorebank NSW 2170. By accessing our website or enrolling your child, you agree to comply with these Terms, the Education and Care Services National Law (NSW), the Education and Care Services National Regulations, the National Quality Standard, the Privacy Act 1988 (Cth) and the Australian Consumer Law.
1. Definitions
“Centre”, “we”, “us” or “our” means MSGM Group Pty Ltd (ABN 26 698 857 493) trading as Early Foundations Academy, 53 Clyde Avenue, Moorebank NSW 2170.
“You” / “Parent/Guardian” means the parent or legal guardian enrolling a child.
“Child” means any child aged 6 weeks to 5 years enrolled at the Centre.
“Services” means early education and care provided by the Centre, including long day care and our preschool program, and any additional programs we may offer from time to time.
2. Acceptance of Terms
By using our website or enrolling your Child, you warrant that you have the authority to agree to these Terms on behalf of the Child.
If you do not agree to these Terms, please do not use our website or enrol at the Centre.
3. Eligibility & Enrolment
Services are available to Children aged 6 weeks to 5 years.
Parents/Guardians must complete an Enrolment Form via our website or in person, including accurate medical, dietary, custody and emergency-contact details.
You must provide all supporting documentation (for example, immunisation records and any court orders) before your Child’s first day of care.
Enrolment is subject to availability and confirmation by the Centre.
4. Fees & Payment
The fee schedule accepted as part of the enrolment process forms part of these Terms.
Payment — all fees are payable in advance by the due date, via direct debit, credit card or as otherwise agreed with the Centre.
Late payment: overdue accounts may incur a late fee of up to 10%. Accounts unpaid 30 days past due may lead to a temporary suspension of care until the account is settled.
Child Care Subsidy (CCS): where applicable, you must confirm your enrolment and provide your CCS details to Services Australia, and pay any gap fees by the due date. Fees are payable in full until CCS is approved.
5. Cancellations & Refunds
Withdrawal or change of days: 30 days’ written notice is required to cancel or reduce permanent bookings. Fees remain payable during the notice period.
Casual bookings: paid in advance and non-refundable.
Illness, holidays and public holidays: fees are not refundable for absences due to illness, holidays or public holidays.
6. Service Provision & Conduct
We aim to provide a safe, nurturing environment guided by the Early Years Learning Framework.
We reserve the right to refuse or withdraw care if a Child’s behaviour poses a risk to themselves, other children or staff, or where a Parent/Guardian behaves in a threatening, abusive or inappropriate manner.
Families must comply with the Centre’s policies and procedures (for example, behaviour guidance, sun safety, nutrition and sign-in/sign-out).
7. Health & Safety
You must inform us immediately of any changes to your Child’s health, allergies or medical conditions.
Contagious illnesses: Children displaying symptoms of a contagious illness must not attend. We may send a Child home at our discretion and may require a medical clearance before they return.
Medication: must be handed directly to staff with a completed Medication Authority form. Medication must be in its original packaging and labelled with the Child’s name.
8. Liability & Insurance
Early Foundations Academy holds public liability and professional indemnity insurance as required by law.
To the extent permitted by the Australian Consumer Law, we exclude all liability for loss, damage or injury, except where caused by our negligence or wilful misconduct.
9. Privacy
We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
We will not disclose your information to third parties, except where required by law, where necessary to administer CCS, or as otherwise described in our Privacy Policy.
10. Intellectual Property
All content on our website, including text, images, logos and branding, is owned by or licensed to Early Foundations Academy. You may not copy or reproduce any content without our prior written consent.
11. Changes to Terms
We may update these Terms at any time. Revised Terms will be published on our website with a new “Last updated” date. Continued use of our website or Services constitutes acceptance of the revised Terms.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under these Terms must be brought in the courts of New South Wales.
